Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and the Genesi OS project ("Genesi OS", "the Project", "we", "us") and govern your access to and use of the Services defined in clause 2.

By accessing the Services, downloading a Genesi OS image or package, creating a Forum account, or submitting any Contribution, you confirm that you have read, understood and accept these Terms. If you do not accept them, do not use the Services.

Genesi OS is a community-operated free and open-source software project. It is not a commercial vendor, does not sell licences, and provides no paid support, service-level agreement or commercial warranty of any kind.

If you use the Services on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms, and "you" refers to that organisation.

In these Terms, the following capitalised expressions have the meanings set out below.

Genesi OS is a Linux distribution derived from CachyOS, which is itself derived from Arch Linux. It is maintained by volunteers and distributed at no charge.

The Services are provided on an "as is" and "as available" basis. We may add, modify, rename, deprecate, suspend or discontinue any part of the Services — including websites, repositories, mirrors, packages, images, update channels, documentation, the Forum or individual features — at any time and without prior notice.

We do not guarantee continuity of any download URL, package name, repository path, API endpoint, update channel or feature. You should not build systems that depend on these remaining stable.

We are not obliged to provide support, security patches, bug fixes, backports or continued maintenance for any version of the Software.

The Software authored by the Project is released under the GNU Affero General Public License, version 3.0 (AGPL-3.0), unless a specific component states a different licence in its own source tree or package metadata.

Third-Party Components remain governed exclusively by their respective licences and are not relicensed by the Project. The licence texts distributed with each component control your rights in respect of it.

These Terms govern your use of the Services — websites, repositories, downloads, the Forum and related infrastructure. They do not purport to restrict any right to use, study, modify, run or redistribute the Software granted to you by the applicable open-source licence.

Where you exercise rights under an open-source licence (for example, by redistributing a modified build), your obligations under that licence — including source availability and notice requirements under AGPL-3.0 — continue to apply and are your responsibility to satisfy.

You must have the legal capacity to enter into a binding agreement in your jurisdiction to use the Services. If you are a minor under applicable local law, you may use the Services only with the consent and supervision of a parent or legal guardian.

An Account is required to publish User Content on the Forum. You may register with an email address and password, an emailed sign-in link, or a supported third-party identity provider.

You are responsible for the accuracy of your registration details, for maintaining the confidentiality of your credentials, and for all activity that occurs under your Account.

You must not share your Account, transfer it to another person, create an Account on behalf of another person without authorisation, operate multiple Accounts to evade moderation, or impersonate any person, maintainer or organisation.

You must notify us at contact@genesios.org promptly if you become aware of any unauthorised access to your Account.

You may delete your Account at any time. The consequences of deletion are described in clause 9.7 and in the Privacy Policy.

Installation images, packages, package databases, repository metadata and update channels are made available to help you install and maintain Genesi OS. They are provided without charge and without warranty.

You are responsible for verifying that a download is appropriate for your hardware and use case, for checking any published checksums or signatures, and for obtaining images and packages only from official sources listed on genesios.org.

We do not warrant that any image, package or repository is free of defects, malware or interruption, nor that any mirror or third-party redistribution of Genesi OS is authentic or unmodified.

Package operations executed on your machine — including installation, upgrade and removal through pacman, the Package Installer, an AUR helper or the Automations feature — act with the privileges you grant them and can modify or render your system unbootable.

Genesi OS is a rolling-release distribution. Packages, kernels, drivers, desktop components and system libraries change continuously, and updates may introduce regressions, break compatibility with third-party software, or require manual intervention.

Testing channels, pre-release builds, unstable drivers and experimental features are provided for evaluation and are expected to be less reliable than the stable channel.

You are solely responsible for maintaining current, tested and independently stored backups of your data before installing, updating or reconfiguring the Software.

Genesi OS includes AI Mode and related tooling that run language models locally on your machine and can, when you enable the relevant mode, execute actions on your system.

The quality, accuracy, safety and suitability of any model output depend on the model you select, its configuration and your prompts. Model output may be incorrect, incomplete, outdated, biased or fabricated.

You must independently review any command, script, configuration change, code or recommendation produced by a model before acting on it or allowing it to be executed.

You must not rely on model output as professional advice, nor as the sole basis for any medical, legal, financial, security, employment or safety-critical decision.

The agent operates in an approval mode or an automatic mode. In approval mode, each proposed action is presented for your explicit authorisation. In automatic mode, supported actions are executed without per-action confirmation.

Enabling automatic mode is a deliberate decision to allow a locally running model to operate your system without individual confirmation. You accept the resulting risk, including the risk of unintended file, package or process operations.

If you connect the Software to any external service — including cloud model providers, remote APIs, Git hosts, package registries, databases or MCP servers — you do so under your own configuration and under the terms and privacy practices of that third party. The Project is not a party to those relationships.

Automations allow you to define workflows in which a trigger — such as a file change, a schedule, a hotkey, a hardware event or the result of a command — causes one or more actions to be executed on your machine.

Automations execute with the privileges of the user account under which the automation daemon runs. Actions may run shell commands, modify or delete files, install or remove packages, launch or terminate processes, send network requests, and invoke language models.

You are solely responsible for the content, correctness and consequences of every workflow you create, import from a template, or copy from any third-party source, and for reviewing it before enabling it.

You must not configure Automations to perform any activity prohibited under clause 11, to attack or disrupt any system, to process data you are not authorised to access, or to circumvent access controls.

Because Automations run unattended and can be triggered without your presence, an erroneous or malicious workflow may cause irreversible data loss or system damage. Test workflows on non-critical data before enabling them.

Genesi OS can draft a workflow from a description you type. The result is a suggestion produced by a model running on your machine, not advice or a warranty that the workflow is correct, complete or safe. It is your workflow the moment you accept it, and clause 8.3 applies to it in full.

The software validates a generated workflow structurally — it discards any step it does not recognise and tells you what it discarded — but it cannot judge whether the workflow does what you meant. Read it before enabling it.

Where you configure an action that signs in to an account of yours, such as sending or reading email, you are responsible for holding the necessary rights to that account, for complying with the terms of the provider concerned, and for any message a workflow sends on your behalf. Credentials are held in your system keyring; safeguarding them is your responsibility.

Where you enable a trigger that accepts inbound network requests, you are responsible for securing it. Such a trigger can start a workflow that executes commands, and exposing one beyond your own machine without the authentication the software requires would allow a third party to run those commands. You must not expose an inbound trigger on a network you do not control.

Where you enable a trigger that reads local input — the clipboard among them — you are responsible for the consequences of the data it may capture, including credentials or personal data copied for an unrelated purpose.

You retain ownership of your User Content. Publishing User Content does not transfer your copyright to the Project.

By publishing User Content, you grant the Project a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt for formatting purposes, publish, display and distribute that content for the purposes of operating, promoting and archiving the Services. This licence lasts as long as the content remains published and for such period thereafter as is reasonably required for backups, moderation records and legal compliance.

You represent and warrant that you own or have all rights necessary to publish your User Content, and that it does not infringe any third-party intellectual property, privacy, confidentiality or other right.

You must not publish credentials, private keys, access tokens, personal data of other people, confidential material, or logs containing secrets. Content published on the Forum is publicly readable and may be indexed by search engines, cached or mirrored by third parties.

We do not routinely pre-screen User Content and are not responsible for it. Opinions expressed by users are their own and do not represent the Project.

We may remove, edit, restrict or refuse any User Content that in our reasonable judgement violates these Terms, applicable law or the standards of the community, without prior notice.

Deleting your Account removes your profile and its personal identifiers. Content that forms part of a public discussion may be retained in anonymised form so that conversation threads and quotations by other users remain intelligible, unless removal is required by applicable data protection law. See the Privacy Policy for details.

Contributions are accepted on an inbound-equals-outbound basis: unless you state otherwise in writing at the time of submission, you licence your Contribution to the Project under the same licence as the component to which it is contributed (AGPL-3.0 for first-party components).

You represent that each Contribution is your original work, or that you have the necessary rights to submit it under that licence, and that your employer or any other party with a claim to the work has authorised the submission where required.

You must not submit code, assets or documentation that you know to be subject to incompatible licence terms, patent encumbrance, export restrictions or confidentiality obligations.

Contributions may be modified, refactored, relicensed within the bounds of the applicable licence, or rejected at the maintainers’ discretion. Submitting a Contribution creates no obligation for the Project to accept, merge, retain or maintain it.

You are not entitled to any compensation for a Contribution, and submitting one does not create any employment, partnership, agency or joint-venture relationship with the Project.

You must use the Services lawfully and in a manner that respects other users and the integrity of the Project infrastructure.

You must not:

If you redistribute modified images, packages, themes, applications or documentation, you must clearly identify them as modified and unofficial, and must comply with the notice and source-availability obligations of the applicable licence.

Security research is welcome, but vulnerabilities affecting Project infrastructure or users must be reported privately to contact@genesios.org and must not be exploited beyond what is necessary to demonstrate the issue, nor disclosed publicly before a reasonable opportunity to remediate.

We may remove content, restrict features, suspend or terminate an Account, or block access to the Services where we reasonably determine that these Terms or applicable law have been breached, or where necessary to protect users, maintainers or infrastructure.

Where proportionate and lawful, we will aim to give notice of and reasons for a moderation decision, and to offer an opportunity to respond. Immediate action may be taken without notice in cases of ongoing abuse, illegal content, security risk or spam.

You may appeal a moderation decision by writing to contact@genesios.org. Appeals are reviewed by a person who was not solely responsible for the original decision where reasonably practicable.

You may stop using the Services and delete your Account at any time.

Clauses that by their nature should survive termination — including clauses 4, 9.2, 9.3, 10, 14, 17, 18, 19, 20 and 22 — survive termination or expiry of these Terms.

The Services rely on third-party infrastructure and platforms, including hosting, authentication, database, source-control and content-delivery providers. Your use of those platforms may additionally be governed by their own terms and privacy policies.

Genesi OS installs and enables you to install Third-Party Components. We do not control, audit or endorse those components and are not responsible for their behaviour, security, licensing or availability.

Links from the Services to external websites are provided for convenience only and do not imply endorsement. We are not responsible for external content.

Software obtained from the Arch User Repository (AUR) or comparable user-contributed sources is built from user-supplied instructions and is not reviewed by the Project. Installing it is at your own risk.

The "Genesi OS" and "GenesiOS" names, the Genesi logo, wordmarks and visual identity are the identifiers of the Project. Rights in these identifiers are not granted by the open-source licence applicable to the source code.

You may use the name and logo to refer accurately to the Project — for example, in reviews, articles, tutorials, comparisons and package descriptions — provided such use does not suggest endorsement or official status.

You may not use the name, logo or visual identity in a way that implies the Project produced, endorses or supports a modified image, fork, package, service or commercial offering, nor in a domain name, application name or product name likely to cause confusion.

If you distribute a modified build, you must rename it or otherwise make its unofficial character unmistakable to users.

The Software may include or interoperate with cryptographic functionality. You are responsible for complying with all applicable export control, import and sanctions laws that apply to you.

You represent that you are not located in, and are not acting on behalf of any person located in, a jurisdiction or entity subject to sanctions that would prohibit your receipt or use of the Software, and that you will not use the Services in violation of such measures.

Our processing of personal data in connection with the Services is described in the Privacy Policy published at genesios.org/privacy, which forms part of these Terms.

Genesi OS is designed to operate locally. The Project operates no telemetry, analytics or crash-reporting endpoint, and the operating system does not transmit usage data, prompts, documents or model outputs to us.

The installer can, at your explicit request following a failed installation, upload its session log to an independent public paste service, and upstream desktop components may offer to send crash reports to their own bug trackers. These transfers are described in the Privacy Policy, are not directed to the Project, and occur only if you initiate them.

If you publish logs, screenshots, crash reports or configuration files when seeking support, you are responsible for redacting personal data and secrets before doing so.

To the fullest extent permitted by applicable law, the Services and the Software are provided "as is" and "as available", without warranty or condition of any kind, whether express, implied or statutory.

The Project, its maintainers and its contributors expressly disclaim all implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, accuracy, security, uninterrupted availability and freedom from error or harmful components.

No advice or information, whether oral or written, obtained from the Project, the Forum, the documentation or any maintainer creates any warranty not expressly stated in these Terms.

Some jurisdictions do not allow the exclusion of certain warranties or of implied statutory rights. Where such law applies, the exclusions in this clause apply only to the maximum extent that law permits, and your mandatory statutory rights are unaffected.

To the fullest extent permitted by applicable law, the Project, its maintainers, contributors, moderators and volunteers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of data, loss of profit, loss of revenue, loss of goodwill, business interruption, hardware damage, cost of substitute goods, or corruption or unavailability of systems, arising out of or in connection with the Services or the Software, regardless of the theory of liability and even if advised of the possibility of such damage.

To the fullest extent permitted by applicable law, the aggregate liability of the Project and the persons listed in clause 18.1 for all claims arising out of or relating to the Services or the Software shall not exceed the greater of (a) the total amount you paid to the Project in the twelve months preceding the event giving rise to the claim, which for freely distributed software is zero, or (b) BRL 100.00.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, for wilful misconduct, or for death or personal injury caused by negligence.

Where you deal with the Project as a consumer under the Brazilian Consumer Protection Code (Law No. 8.078/1990) or comparable consumer legislation, the limitations in this clause apply only to the extent permitted by that legislation, and your mandatory consumer rights remain unaffected.

You agree to indemnify and hold harmless the Project, its maintainers and its contributors from and against any third-party claim, demand, proceeding, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or related to your User Content, your Contributions, your use of the Services, your redistribution of the Software, your configuration or operation of Automations or agent features, or your breach of these Terms or of applicable law.

This clause does not apply where the claim arises from the Project’s own wilful misconduct, and does not apply to the extent that applicable consumer protection law prohibits such an indemnity.

These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to conflict-of-law rules.

The courts of the Federative Republic of Brazil shall have jurisdiction over any dispute arising out of or in connection with these Terms.

If you are a consumer resident in another jurisdiction, this clause does not deprive you of the protection of mandatory provisions of the law of your country of residence, nor of the right to bring proceedings before the competent courts of that country where applicable law so provides.

Before commencing formal proceedings, we encourage you to contact us at contact@genesios.org so that the matter can be examined and, where possible, resolved informally.

We may revise these Terms to reflect changes in the Software, the Services, our infrastructure or applicable law.

The version identifier, effective date and revision date at the head of this document indicate the current version. For material changes, we will take reasonable steps to give notice through the website or the Forum before the new version takes effect.

Your continued use of the Services after a revised version takes effect constitutes acceptance of it. If you do not accept a revised version, you must stop using the Services and may delete your Account.

Severability. If any provision of these Terms is held invalid, illegal or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force.

No waiver. A failure or delay in enforcing any provision of these Terms is not a waiver of the right to enforce it later. A waiver is effective only if given in writing.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to a successor entity, foundation or maintainer group responsible for the Project.

Force majeure. Neither party is liable for failure or delay in performance caused by events beyond its reasonable control, including infrastructure outages, upstream provider failures, network disruption, natural events, industrial action or acts of public authority.

No agency. These Terms do not create any partnership, joint venture, employment, agency or fiduciary relationship between you and the Project.

Entire agreement. These Terms, together with the Privacy Policy and any applicable open-source licence, constitute the entire agreement between you and the Project in respect of the Services, and supersede any prior understanding on that subject.

Language. These Terms are published in English. If a translation is provided for convenience and there is any inconsistency, the English version prevails to the extent permitted by applicable law.
